In late 2016, U.S. Citizenship and Immigration Services (US CIS) released a newly revised Employment Eligibility Verification form, commonly referred to as the I-9 form, with a date of 11/14/2016 in the bottom left corner. Employers are required to use only this new version of the I-9 form starting January 22, 2017. To download a copy of the new version of the I-9 form click here. Employers who fail to use the new version I-9 form will be subject to penalties as enforced by U.S. Immigration and Customs Enforcement and the Department of Justice. To help ensure that the correct version of the I-9 form is used, blank copies of the prior version of the I-9 form should be discarded.
On and after January 22, 2017, use of the new version of the I-9 form is required for new hires, re-hires and re-verifications of current employees. Employers should not ask current employees who have a properly completed I-9 form on file to complete the new version of the I-9 form.
If you have questions regarding your I-9 form obligations, please contact Jeffrey M. Embleton, Amy L. Kullik, James A. Budzik or Ann E. Knuth in our Labor and Employment Group.
