The case involved Duravant LLC Operating Company, Multiscan Technologies, SL (a Spanish legal entity) and its US subsidiary, facing legal challenges from Avision Electronics Designs, LLC in a Washington state lawsuit alleging breach of contract, unjust enrichment, and violations of Washington’s Unfair Business Practices Act, seeking over $500,000 for the contract claims along with treble damages and attorney fees. The underlying dispute involved an agreement for sole distributorship for two of Multiscan’s sorting machines. The parties agreed to arbitrate the matter and to apply Spanish law to the contract at issue.
Jordan Ramis Attorney and lead counsel Daniel Sharp adopted a strategic, client-focused approach, navigating through complex legal frameworks and international law intricacies to protect his clients’ rights and interests.
At the heart of Jordan Ramis PC’s strategy was a nuanced application of Spanish law, supplemented by expert intellectual property knowledge. Sharp was supported by Kurt Rylander of Rylander & Associates who associated with Jordan Ramis as intellectual property counsel.
Advocating on behalf of Defendants Multiscan Technologies and Multiscan Technologies USA, Jordan Ramis PC brought a Motion for Summary Judgment on all three of the plaintiff’s causes of action. Applying both Spanish law, through the use of foreign experts and witnesses, and touching on related intellectual property issues raised by the plaintiff, Jordan Ramis PC successfully convinced the Arbitrator to dismiss all of the plaintiff’s causes of action in their entirety and to award Multiscan Technologies and Multiscan Technologies USA’s attorney fees and costs of $506,142.52.
