NSTLAW Stankovic & Partners Represents Investors in ICSID Case

Belgrade, June 6th, 2022 - NSTLAW Stankovic & Partners represents Cypriot and Canadian investors in a new investor protection case against the Republic of Serbia. The case was registered on 27 May 2022 before the International Center for Settlement of Investment Disputes, under the case no. ARB/22/14.

Currently, there are seven pending arbitrations against the Republic of Serbia before ICSID. NSTLAW team is acting in four of the seven and this experience is hugely beneficial for our clients. We are also proud to be Co-Counsel along with the international dispute resolution team of Squire Patton Boggs for the second time.

Coropi Holdings Limited, Kalemegdan Investments Limited and Erinn Bernard Broshko are taking their case against the Republic of Serbia to ICSID to seek arbitration on a real estate project. For more information, please visit the ICSID link.

ICSID - a member of World Bank Group - is the world’s leading institution devoted to international investment dispute settlement. It has extensive experience in this field, having administered the majority of all international investment cases. States have agreed on ICSID as a forum for investor-State dispute settlement in most international investment treaties and in numerous investment laws and contracts.

There are currently 164 signatory and contracting states in the ICSID.

Panels of Arbitrators and of Conciliators

The ICSID Convention entitles each Member State to designate up to four persons to the Panel of Arbitrators and up to four persons to the Panel of Conciliators (Article 12 to 16 of the ICSID Convention). In addition, the Chairman of the Administrative Council of ICSID may designate up to ten persons to each Panel.

The designees of a Member State may be of any nationality. They serve for a renewable term of six years and may serve on both Panels simultaneously.

The arbitrators and conciliators listed on the Panels are available for selection to ICSID Tribunals, Conciliation Commissions and ad hoc Committees. The Panel lists are used most often to appoint where the parties are unable to agree on a nominee (see Selection and Appointment of Tribunal Members). The Panel of Arbitrators is also used for appointment to ad hoc Committees.
